Content Guidelines

General
The present Content Guidelines explain the rules, technical standards, and prohibitions regarding the use of the application: lorka.ai (hereinafter, “the App”), which is owned and operated by Palatine Global Capital LLC, a private company holding TAX ID number 93-4044183, and its registered office at 103 Century 21 Drive Suite 213 Jacksonville, FL 32216 and contact email: info@lorka.ai (hereinafter, “the/our Company”, “we”, “us”, “our”). The App is not affiliated with any other platforms or third parties.
These Guidelines are an integral part of our Terms of Service. The download and/or use of the App implies that you have read, understood, and fully accepted these Content Guidelines. If you do not agree with them, please stop using the App.
To use the App, the User must be an adult (at least 18 years old or the legal age of majority in their country or state of residence). Minors are strictly prohibited from using the App. The Company reserves the right to suspend or terminate any accounts identified as belonging to minors.
Definition of “Blocked Content” or “NSFW Screen”
For the purposes of these Content Guidelines, “Blocked Content” or an “NSFW Screen” refers to any image, video, or text input that is automatically restricted by the App’s safety systems due to a potential violation of these Guidelines.
When such content is detected, the App will prevent the processing, analysis, or generation of output based on the provided text or image, and display a warning or restriction notice instead.
Prohibited Content and Safety Ratings
The App employs internal safety filters to ensure that the content mirrored or processed through the platform complies with safety standards. Any content or request rated as “Adult Content” or “Violence” by our system will be automatically blocked. These safety ratings are generated automatically.
These restrictions apply to all content displayed through the App, regardless of its origin, whether it comes from the User’s device or from third-party applications, services, or platforms.
The App’s safety filters and automated technical systems may be provided, in whole or in part, by third-party service providers. Consequently, the filtering criteria, safety standards, and prohibited content categories also apply to the use of the App. The Company shall not be liable for any content blocked or restricted based on the technical standards or safety policies.
The list of prohibited content includes, but is not limited to:
- Explicit or Adult Material: Sexually explicit or suggestive material, pornography, or images intended to sexually arouse. Any sexual content involving minors or sexualization of minors is strictly prohibited.
- Harmful or Illegal Content: Material that promotes illegal activities, violence, self-harm, or dangerous behavior.
- Violent or Disturbing Content: Content that promotes self-harm, cruelty, or depicts weapons in threatening or illegal contexts.
- Privacy and Identity: Content that shows identifiable people or private situations without their consent or legal authorization, or prompts intended to extract personal private data (doxxing).
- Hate Speech and Harassment: Content that discriminates against, attacks, or harasses individuals or groups based on race, gender, religion, sexual orientation, disability, or other protected characteristics.
Validation of User Inputs
To ensure a safe experience, user inputs are subject to multi-layered safety mechanisms:
- Text Input Filtering: Our system may block inappropriate, explicit, or offensive language, including attempts to disguise, obfuscate, or manipulate language (e.g., prompt injection or jailbreaking attempts) in order to generate prohibited content.
- Visual Content Inspection: The App may implement automated scanning systems or security filters to inspect user-uploaded images prior to processing to verify that they do not contain prohibited visual material.
- Third-Party AI Models & Direct Provider Safety Responses: The third-party Large Language Model (LLM) providers and AI service vendors integrated into the App maintain their own automated safety systems and content detection filters. If a text prompt or uploaded image triggers a safety restriction enforced by an underlying LLM or third-party provider, the processing request will be rejected by such provider. Upon receiving this notification from the provider, the App will take appropriate measures, which may include restricting the request, blocking the generated output, or notifying the User accordingly.
- Enforcement & Account Termination: Any attempt to bypass, disable, or circumvent these filters (whether for text prompts or uploaded images) to process prohibited content may result in the immediate suspension or termination of your account as per our Terms of Service.
Technical Notice: “False Positives”
The User acknowledges that safety filters may occasionally trigger a “False Positive”, blocking content that does not actually violate our policies. This may occur due to ambiguous context, complex phrasing, or figurative/artistic visual elements.
If you encounter a false positive, you may try uploading a clearer, higher-resolution version or rephrasing your text prompt.
A false positive does not imply that the content is approved or permitted, nor does it create any right for the User to access or process such content.
Protection of Minors and Shared Viewing Environments
Given that generated or processed content may be exported, shared, or displayed in public or multi-user environments, the User agrees not to upload images or input text prompts aimed at generating, processing, or sharing material that could be harmful to minors or third parties. The App employs automated filters, safety mechanisms, and technical measures to detect and prevent the generation or display of prohibited, inappropriate, or sensitive content.
No Guarantee and No Right to Access Restricted Content
The User acknowledges that access to specific content is not guaranteed. The Company is under no obligation to restore, unblock, or allow access to any content that has been restricted by the App’s safety systems, even if the User believes such restriction to be incorrect.
User Responsibility
The User is solely responsible for any text prompts entered and any images uploaded or generated through the App. The Company shall not be liable for any consequences arising from the User’s attempt to process prohibited or restricted content.
Use of Content
In accordance with our Terms of Service, Users are granted a non-exclusive license to use the App for personal or internal business purposes, subject to the active subscription plan purchased. Any unauthorized distribution, reselling, or commercial exploitation outside the scope permitted by your plan or official partner/affiliate agreements is strictly prohibited.
Enforcement and Reporting
The Company reserves the right, at its sole discretion and without prior notice, to suspend or terminate access for any User who violates these Guidelines and cooperate with administrative or judicial authorities when legally required to do so. To report a violation, please contact: info@lorka.ai
Applicable law and jurisdiction
These Content Guidelines shall be governed by and construed in accordance with Spanish law.
In the event of any controversy, claim, or disagreement arising out of or relating to these Content Guidelines or the use of the App, the parties expressly agree to submit the dispute to the exclusive jurisdiction of the Courts and Tribunals of Barcelona, Spain, expressly waiving any other jurisdiction to which they may be entitled.
The non-exercise by the Company of any right provided in these Content Guidelines shall not be construed as a waiver of said right.
